Offer agreement for booking day yacht tours

This document is a public offer of the Sails & Business service and governs the terms of booking day yacht tours through the Telegram Mini App / Telegram bot. By confirming a request, paying for a booking, or using the service, the Client confirms acceptance of this offer.

1. General provisions

1.1. The Sails & Business service provides an information platform for booking day yacht trips.

1.2. Sails & Business is not a shipowner, carrier, cruise company, or tour operator unless stated otherwise.

1.3. The service is performed by the captain, shipowner, or authorized person who confirms the booking.

1.4. All decisions related to departure safety, weather conditions, route, and onboard conduct are made by the captain.

1.5. The Client books a yacht format and class, not a specific vessel.

1.6. Photos published in the service are for reference only and may differ from the vessel actually provided within the selected tariff.

2. Formats and tariffs

Easy — up to 6 guests

A basic day-sail format on a sailing yacht.

Most often sailing monohulls from 35 to 44 feet are used.

Minimum equipment level:

  • at least 1 toilet;
  • at least 1 changing cabin;
  • music system;
  • basic tableware and equipment.

The owner or their family may live on board permanently. The tour may be run by a captain together with an assistant.

Comfort — up to 8 guests

An enhanced-comfort format for a day at sea.

Modern sailing monohulls from 45 to 49 feet are used more often.

Features:

  • more space in the cockpit;
  • comfortable lounging areas;
  • refrigerator;
  • toilet;
  • changing cabin;
  • the yacht is kept ready for departure and is not used for permanent residence.

As a rule, the tour is run by a single captain.

Premium — up to 12 guests

A format with a higher level of comfort and space.

Modern yachts are used:

  • sailing monohulls from 50 to 59 feet;
  • mainly sailing catamarans from 40 to 45 feet.
  • larger lounging areas;
  • high comfort level;
  • more space on board;
  • premium/lounge relaxation areas.

Catamarans may appear in different tariffs, but they mainly belong to the Premium category.

Time windows:

  • 4 hours — 09:00–13:00 or 15:00–19:00
  • 6 hours — 12:00–18:00
  • 8 hours — 10:00–18:00

The price is dynamic and depends on:

  • yacht level;
  • seasonality;
  • fleet occupancy;
  • booking date.

Included in the price:

  • captain services;
  • fuel;
  • basic equipment;
  • music system;
  • tableware and utensils.

Not included in the price:

  • berthing outside the base marina;
  • food and drinks;
  • towels;
  • snorkeling equipment;
  • SUP boards;
  • individual additional services.

3. Booking

3.1. The Client submits a request through the Telegram Mini App or Telegram bot.

3.2. A request is considered confirmed only after captain confirmation and receipt of payment.

3.3. Sails & Business may refuse to confirm a request without giving reasons.

3.4. If no yachts are available in the selected tariff, the Client may be offered an alternative or the request may be cancelled without obligations for either party.

3.5. Sails & Business does not guarantee availability of yachts for the selected date and time.

4. Payment and cancellation

4.1. Payment is made by bank card or another available method.

4.2. A booking is considered active only after payment confirmation.

4.3. If the Client cancels less than 48 hours before departure, the prepayment is non-refundable.

4.4. If departure is cancelled due to weather, technical failure of the vessel, or the captain’s decision, a new date, refund, or alternative departure may be offered.

4.5. Bank, payment-system, and third-party service fees are non-refundable.

4.6. Refunds are processed within timeframes that depend on the payment system and the Client’s bank.

5. Conduct and liability

5.1. The Client must follow the captain’s instructions and safety rules.

5.2. The captain may refuse boarding to persons under the influence of alcohol or drugs, aggressive passengers, and persons who create a threat to the crew, guests, or vessel.

5.3. The Client is financially liable for damage to yacht property caused by their fault.

5.4. The Client is independently responsible for having the required documents, health condition, compliance with migration and customs rules, and personal belongings.

5.5. Sails & Business is not liable for weather conditions, route changes, departure delays, captain actions, port-service restrictions, force majeure, mobile or internet quality, or loss or damage of personal belongings.

6. Photos and media

6.1. Photo and video recording may take place during the tour.

6.2. The Client agrees to possible use of photo and video materials on social networks, in advertising, and in Sails & Business marketing materials unless they notify refusal in writing in advance.

7. Personal data

7.1. The Client consents to processing of personal data required for booking, communication, and organizing the departure.

7.2. Data may be shared with the captain, shipowner, payment services, and other parties involved in organizing the service.

8. Final provisions

8.1. Sails & Business may change the terms of this offer without prior notice.

8.2. The current version of the offer is published in the app and on the website.

8.3. Payment, request confirmation, or use of the service means the Client’s full and unconditional acceptance of this offer.
